We are committed to empowering you to make the best decisions about the information that you share with us. We are also committed to be transparent about the data we collect about you, how it is used and with whom it is shared.

GotoSailing.com is owned and operated by GotoSailing.com B.V. ("GotoSailing.com," “we,” “us,” or "our"), a company registered in Weipoortseweg 34, 2381NC Zoeterwoude, The Netherlands. This Privacy Policy covers how we collect, use, process and disclose your information through the website at www.GotoSailing.com ("Site"). When this policy mentions “GotoSailing.com,” “we,” “us,” or “our,” it refers to the GotoSailing.com company that is responsible for your information under this Privacy Policy.

This Privacy Policy also covers the Payment Services provided to you by GotoSailing.com Payments pursuant to the Payments Terms of Service (“Payments Terms”). When you use the Payment Services, you will be providing your information as well as personal information, to one or more GotoSailing.com Payments entities.

References to the Site include but are not limited to mobile websites and applications. This Privacy Policy covers any information we get through these platforms or other means associated with these platforms. By visiting the Site, you are consenting to the collection, use, disclosure and processing of your Personal Data as described here.

Revisions can be made to this Privacy Policy due to changes in the law, advances in technology, Site features, the way which we collect Personal Data or use practices. If we do make revisions that modify the way we collect or use Personal Data, all changes and the effective date will be described in this Privacy Policy. To stay up to date on our latest practices, we advise you to check the Privacy Policy regularly.

You may reject this Privacy Statement as a whole or not agree with the changes or modifications made to it. Then you should not proceed with our services.

1. The Nature of the Personal Data We Collect

A. Data you give us about yourself

This data is crucial for the satisfactory performance of our mutual contract and to let us comply with our legal obligations. Without this data, we may fail to provide you with the services you requested.

The personal data we collect about you is what you provide us when you use the Site. When you start a GotoSailing.com account, we’ll need basic data such as your first name, last name, email address and date of birth. Personal data may also include your preferences like the name of the booked boat, charter boat location and/or length of charter.

When you use our Site, even if you do not complete a booking, we may collect certain data such as your password, the pages you viewed, preferences regarding your searches as well as your geographic data, IP address, your nationality, the browser type you’re using, your computer’s operating system, its application version and language settings. If you are using a mobile device, we might also collect data that recognizes your mobile device, its related settings and characteristics along with latitude/longitude specifics.

When you make a booking, our system registers how and from which websites the booking took place. When you get to the payment step, we also collect your financial data such as your bank account or credit card information.

To establish and maintain an environment of trust, we may collect identity verification data or other authentication data including passport, national ID card, images of your government issued ID or driving license, as permitted by applicable laws. When necessary, the Charter Operator may also request proof of your navigational skills, such as your license and sailing resume details.

When you contact our customer service team or get in touch with us through another platform such as social media, we collect that data. The same process applies when you communicate with your Charter Operator or any related party through our site. Sometimes we can ask you for comments about your stay, in order to improve our services. We'll collect information from you included in your reviews, like your display name and avatar if you choose one.

To help us give you the best possible service, there are some other circumstances where you provide us with information. For instance, if you’re browsing with your mobile device, you can allow GotoSailing.com to see your location or give us access to your contact details. You can also benefit from a user account, which allows you to save your personal settings, keep track of previous bookings, plan and manage future reservations or simply upload photos.

When you take part in referral programs, when you give us feedback or ask for help when using GotoSailing.com services, you’re also providing us with personal information.

To obtain a better user experience when using GotoSailing.com Site, you may choose to provide us with additional personal data. This additional data will be processed based on your consent. You may choose to provide additional data such as gender, preferred language(s), city, and a personal description as part of your GotoSailing.com profile. As stated in your Account settings, some of this data is part of your public profile page, and will be publicly visible to others. To access certain features of the GotoSailing.com Site, like inviting them to use GotoSailing.com, you may choose to import your address book contacts or enter your contacts’ data manually. When you conduct a search, fill in a form, update or add data to your GotoSailing.com Account, answer surveys, participate in promotions, post to community forums or use other features of the GotoSailing.com Site, you may also choose to provide us data.

To process payments, we need to collect certain data, as it is necessary for the satisfactory performance of our mutual contract and to comply with applicable law such as anti-money laundering regulations. Without this data, you will not be able to use Payment Services. When you use the Payment Services, it requires financial data like your bank account or credit card data in order to process payments and comply with applicable law. If you are a Charter Operator, the Payments Services may require identity verification data including passport, national ID card, images of your government issued ID or driving license as well as other authentication data like your address, email address, your date of birth, phone number with the purpose of verifying your identity, providing you with the Payment Services, and complying with applicable law.

B. Data you give us about others

You might be booking on behalf of someone else or traveling with a crew. In either case, you need to provide data about these people as well.

Please make sure that the person or people of whom data you’ve provided, know about this procedure and accept the ways GotoSailing.com can use their data. We need to remind you that this process is your responsibility.

If you use your GotoSailing.com account for business related travel, you can create an address book or manage the data of others. Sometimes, you might want to use GotoSailing.com to share information with others by forwarding a wish list or taking part in referral programs. Such data may only be used as described in the related section. Please check the details.

C. Data automatically collected

When you visit GotoSailing.com or related apps, there’s certain data we may collect automatically, even if you don’t proceed with a booking. This is part of your digital footprint and it includes your IP address, the date and time you accessed the Site, along with the hardware and software specifics, your computer’s operating system, its application versions, language settings and the browser you use.

When you interact with our Site, for example, when you view pages or other content, search for boats or destinations, make bookings, we collect data about these actions.

When you make any financial transactions on the Site, data including the date and time, charged amounts and other related transaction details is automatically collected.

When you use a mobile device, we might also collect data that recognizes your mobile device along with device-specific settings and characteristics, app crashes and other system activity. When you make a reservation, our Site registers from which websites and through which means you've entered GotoSailing.com and/or apps and made your booking. When you use certain features of GotoSailing.com, we may collect different types of data about your general location (e.g. IP address, zip code) or more specific location information from your mobile GPS. Please note that you can control or disable the use of location services for applications by changing your settings.

When you access and use the GotoSailing.com Site, we collect device information and log data automatically, even if you have not created a GotoSailing.com Account or logged in. That information contains details about how you’ve used the GotoSailing.com Site (including if you clicked on links to third party applications), hardware and software information, IP address, access dates and times, device information, device event information, unique identifiers, cookie data, crash data and the pages you’ve viewed or engaged with before or after using the GotoSailing.com Site.

We use cookies and similar technologies such as mobile identifiers, web beacons and pixels. We might make these tracking technologies on the Site available to our business partners and we might allow these partners to track your actions on our behalf.

You may disable the use of cookies through your browser settings, but please note that the GotoSailing.com Site currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application because there is no standardization on how that signal should be interpreted. Payment transaction data is the information GotoSailing.com Payments collects regarding your payment transactions through the GotoSailing.com Site, including the date and time, payment amount, payment instrument used, expiration date for payment instrument and billing postcode, IBAN information, your address and other related transaction details. This data is crucial for the satisfactory execution of the contract between you and GotoSailing.com Payments as well as to allow the provision of the Payment Services.

D. Data collected from other sources

GotoSailing.com and GotoSailing.com Payments may collect personal or other data which others provide about you when they use the GotoSailing.com Site and the Payment Services. We might also obtain data from other sources and combine that with information we collect through the GotoSailing.com Site and the Payment Services. We do not control, supervise or answer for how the third parties providing your information process your personal data. Information requests about the disclosure of your personal information to us, should be directed to such third parties in question.

Sometimes business partners, affiliated entities or other third party providers may share data with us. Their data might be merged with the data you already provided. For example, the GotoSailing.com reservation services may be integrated into online affiliate partner services. When you use these, you give the reservation details to our business partners, then they forward your details to us.

To improve the payment process between Charter Operators and Charterers, we may employ third party service providers. These service providers share payment data so that we can handle your booking process in the best possible way.

To enable you to connect with the booked charters about your stay, we may integrate calling services into our platforms. When we do, we receive metadata including who you are, where you called and the date and length of the call. We might also receive data about you to show you more relevant ads.

When you use a third party social media service to link, connect, or login to your GotoSailing.com account, the third party service may send us the information you provided them. This information may include your registration and profile details; depending on your privacy settings for that service.

Charter Operators might share information about you with GotoSailing.com. When you have questions regarding your reservation, or when you face a problem, all communication through GotoSailing.com will be registered.

Within the limits of the law, we may receive additional data from third party service providers and/or partners, such as demographic data or fraud detection information. We may combine this with the data we already have. For example, for fraud prevention and risk assessment efforts, we may receive background check results or fraud warnings from service providers like identity verification services. Our partners can share information about you and your activities on and off the Site. We can also collect information about your experiences and actions from our partner ad networks.

 

2. The Use of Collected Data

We use, store, and process data about you with the purpose of making your online bookings easier and safer, providing you with the best service possible and improving our Site.

A. What we do with the personal data and other information collected through our Site

We register you with GotoSailing.com, create your user account, grant you access to the Site, manage your online reservations and let you communicate with others. We communicate with you in order to handle requests from you or your Charter Operator.

We provide guests and Charter Operators with means to communicate so that you can exchange information on requests and comments regarding reservations directed through our Site.

We offer you the services you requested after authenticating your credentials, enable you to pay for your charter using our payment platform.

We process and confirm your reservation with the Charter Operator or other suppliers.

We remind you of any non-finalized reservations so that you can continue without having to search or fill in your reservation details again.

We provide updates, security alerts and account notifications in the form of service or support messages. This could be about our Site or about other websites. We also communicate with you- if necessary - to provide requested services.

We constantly improve our services to enhance user experience and add features that will make the services available on the Site easier to use, but also test, troubleshoot and improve the functionality of our Site. We conduct surveys, send you questionnaires or ask you to comment on your experience with your boat and/or our Site.

We customize your experience by ranking search results or showing ads related to your preferences, searches or booking history. We do this for internal training and general optimization purposes.

We conduct profiling based on your interactions with the GotoSailing.com Site such as your search and booking history, your profile information and preferences, and other content you submit to the GotoSailing.com Site. We do this to manage, safeguard, enhance and optimize the GotoSailing.com Site and experience as well as to personalize and customize your experience such as ranking search results or making Listing suggestions. With our legitimate interest in improving the GotoSailing.com Site and our Members’ experience with it, and where it is necessary for the adequate performance of our mutual contract, we process this information.

We contact you if there are any problems or issues regarding your booking. What we aim here is faster response to faster purchase requests, better customer support and sooner notice of special offers or new services. We do our best to provide a safe and trustable service. We detect and prevent fraud, spam, abuse, security threats and other illegal or unwanted activities. We comply with our legal obligations.

B. How we conduct marketing activities

To the extent permitted by law, we personalize, measure, and improve our Advertising and Marketing activities. We may inform you on products and services to promote them. Based on your preferences, we may provide other relevant information that may be of interest to you and Charterers.

If you consent, we may email you regular newsletters. Every piece of marketing communication we provide has a link which allows you to unsubscribe any time. You can also manage your subscriptions through your account.

Based on the personal information you share with us, we may show you individualized offers on the Site, in mobile apps or on third-party websites, including social media. These might be offers that you can book directly on the Site, or third-party offers or products we think you might be interested in.

If you have any online reservations that are not finalized, we may send you a notice to remind you to proceed with your reservation. This additional service is especially useful because it allows you to proceed with a reservation without having to go through the same searches or fill in all the reservation details once more.

When you participate in promotional activities like referral programs, the related information will be used to manage surveys, contests, rewards and referral programs as well as other promotional activities or events. These activities or events can be sponsored or managed by GotoSailing.com as well as its third party business partners.

We need to remind you that the confirmation emails and text messages sent after your booking are not marketing messages. Along with confirmation messages, guest review emails sent after your departure, they are part of your booking process. You will continue to receive them, even if you have signed out of our marketing messages. They contain information for you to check in at your booked charter, and tools to rate that boat after you check out.

Regarding the activities above, we may conduct profiling based on your interactions with the GotoSailing.com Site, your profile information and other content you submit to the GotoSailing.com Site as well as information obtained from third parties. In rare cases, automated processes may detect a Member or activity that we think poses a safety or other risk to the GotoSailing.com Site, other Members, or third parties. In this case the same automated processes may restrict or suspend access to the GotoSailing.com Site. It is with our legitimate interest in protecting the GotoSailing.com Site, to measure the satisfactory performance of our mutual contract, and to comply with applicable laws, that we process this information.

C. How we process credit card data

To book and to pay faster and easier in the future, you can save your credit card details to your personal account as you log in. Your card information is secured by strong encryption. You can always log in to your personal account and delete, edit or add certain credit card details. For security reasons, the number cannot be edited but the card details can be deleted. When viewing card details, only the last 4 digits of the number will be shown. Please remember that we will securely store the last 4 digits of your credit card upon any booking made. We need this to handle any refund requests for that booking.

3. Data Sharing

We may share your data as you choose or as stated at the time of sharing. This can be the case when you authorize a third party application or website to access your GotoSailing.com Account. We may share your personal data with Charter Operators and suppliers that provide services on our behalf, such as web hosting, data analysis, third party loyalty programs, marketing (also on websites of such third parties), customer care, credit card and payment services and related services.

We help the exchange of information between Charterers and Charter Operators. When you make a booking, we transfer reservation details to the related Charter Operator. This information can include your full name, contact details, payment details, the names of guests traveling with you and the preferences you noted during booking. When you have a question about your booking, we may contact the Charter Operator and ask them to handle your request. If there’s any booking-related dispute, we may give the Charter Operator related information about the reservation process. This could be in the form of a copy of your booking confirmation as proof that a reservation was actually made.

We share information with your local GotoSailing.com office. To support the use of GotoSailing.com services, we may share your information with subsidiaries of the GotoSailing.com corporate family.

We allow Charter Operators publish certain information and make it visible to the general public. For instance:

i. Parts of the information you share on your public profile page are publicly visible. This may include your company name, Charter Operator’s full name, your boat listings’ descriptions and location.

ii. Public boat listing pages are publicly visible. They include information such as the boat’s approximate location, calendar availability, boat listing description, the Charter Operator public profile photo, logo, contact details, aggregated demand information like page views over a period of time, and any other information the Charter Operator chooses to share.

iii.Charterers may write reviews and rate Charter Operators after booking. Reviews become visible on the Charterer’s and Charter Operator’s public profile page.

Third party search engines may index information that you as Charterer share publicly on our Site. You may be able to opt-out of this feature in your Account settings. Please remember that if you change your settings or your public-facing content, these search engines may not update their databases and that we are not accountable for the practices of third party search engines.

By completing a guest review, you're agreeing that it can be displayed on the relevant Charter Operator’s boat listing page on our websites, social media accounts and social media apps and mobile apps. Your reviews can also be displayed on the website of the relevant accommodations or business partner’s website. This serves an important purpose: to inform other Charterers about the quality of the boats you stayed in, the destination you picked, or other services you used. When you submit a review, share content in a public forum or social media post, or use a similar feature on the Site, that content is publicly visible. Members of our Site can choose to review with a user name instead of their real name. User names can be selected in the user settings. You can also choose to display your review anonymously.

You may want to state whether a guest review is helpful or not. When you do, we'll group this with feedback from other customers in order to rate and sort reviews. We may use the information in your lists or in other related information you share with us anonymously, unless you've included this information in your public profile. Please remember that this procedure helps Charterers like you make the best boat and destination choices possible.

We may appoint certain service providers to process your personal data on our behalf. Third-party service providers are bound by confidentiality clauses and are not allowed to use your personal data for other purposes. Service providers processing your data may help us with important processes such as: a) verifying or authenticating your identification, b) checking information across public databases, c) help us with background checks, fraud prevention, and risk assessment, d) provide customer service, advertising, or payments services. To perform these tasks on our behalf, providers in question have limited access to your information, and are bound by contract to use it within this Privacy Policy.

We may share your data with payment providers and (other) financial institutions. You or the holder of the credit card you used to make your booking, may request a chargeback. When this is the case, we may need to share certain reservation details with the payment service provider and the relevant financial institution to handle your request. Information we share may include a copy of your booking confirmation or the IP address used during booking. If we consider it strictly necessary for fraud detection and prevention purposes, we may also share information with relevant financial institutions.

4. Promotion of a safe and trustworthy service

In order to create a trustworthy environment for you, your fellow Charterers, GotoSailing.com’s business partners, and our Charter Operators, we might use personal data for the detection and prevention of fraud and other illegal or unwanted activities. Similarly, we might use personal data for risk assessment and security purposes, including the authentication of users and reservations. For such purposes, we might have to stop certain reservations or put reservations on hold until we've finished our assessment.

Legal purposes: Finally, in certain cases, we might need to use your information to handle and resolve legal disputes, for regulatory investigations and compliance, to enforce the terms of use of the GotoSailing.com online reservation service, or to comply with lawful requests from law enforcement.

Providing your personal data to GotoSailing.com is voluntary. However, depending on the type of service you want to use, we might only be able to provide you with this service if certain personal data is collected. For instance, we cannot process your Reservation if we don't collect your name and contact details.

If we use automated means to process personal data that produces legal effects or significantly affects you, we will implement suitable measures to safeguard your rights and freedoms, including the right to obtain human intervention.

To process your personal data as described above, we rely on the following legal bases:

In view of purpose of necessary information such as Reservations and Customer Service, GotoSailing.com relies on the legal basis that the processing of the personal data is necessary for the performance of a contract, specifically to finalize and administer your Reservation. If the required personal data is not provided, GotoSailing.com cannot finalize the Reservation, nor can we provide customer service. In view of purposes secondary information such as Account Facilities, Online Groups, Marketing Activities, Communicating with you, Market Research, improving our services, member reviews, call monitoring and promotion of a safe and trustworthy service, GotoSailing.com relies on its legitimate commercial business interest to provide its services, to prevent fraud, and to improve its services. When using personal data to serve GotoSailing.com’s or a third party's legitimate interest, GotoSailing.com will always balance your rights and interests in the protection of your personal data against GotoSailing.com’s rights and interests or those of the third party. For legal purposes, GotoSailing.com also relies where applicable on compliance with legal obligations (such as lawful law enforcement requests). Where needed under applicable law, GotoSailing.com will obtain your consent prior to processing your personal data for direct marketing purposes.

5. Data Sharing with Third Parties

We may share data with competent authorities. For the prevention, detection or prosecution of criminal acts and fraud, we may disclose personal data to law enforcement if it is required by law or is strictly necessary. We may also need to disclose personal data to competent authorities in order to protect and defend our rights or properties, or the rights and properties of our business partners.

In compliance with applicable law, we may disclose personal data to protect ourselves against liability, to respond to subpoenas, judicial processes, legitimate requests, warrants or equivalent by law enforcement officials or authorities. Data may be used to investigate fraud or other wrongdoing or as otherwise required in order to comply with applicable law. To protect our legitimate interests or to the purchasers in connection with any sale, assignment, or other transfer of all or a part of our business or company, we may disclose information to law enforcement officials or authorities. We may also, in compliance with applicable law, disclose personal data to enforce or apply the terms and conditions applicable to our services or to protect the rights, property or safety of GotoSailing.com, our users or others. Please remember that, in the situations described above, the recipient of the Personal Data may be located in a jurisdiction that may have different standards of data protection compared to those in your home jurisdiction.

We may share data with tax authorities. In jurisdictions where we facilitate the collection and remittance of taxes, Charterers and Charter Operators expressly grant us permission, without further notice, to disclose their relevant data and other information relating to them or to their transactions, bookings, and taxes to the relevant tax authority, including, but not limited to, the Charterer or Charter Operator’s full name, boat listing addresses, transaction dates and amounts, tax identification number(s), the amount of taxes received (or due) by Charter Operators from Charterers, and contact information.

We may use your data to create aggregated data. That is, we may combine information about our users in a way that it no longer identifies or references an individual user. We may also share this aggregated information for market and industry analysis, research, demographic profiling, marketing and advertising and other business purposes.

We may share data with corporate affiliates. We work with business partners around the world. Some of these business partners distribute or advertise our services, and they help our other business partners distribute and advertise their own travel-related services. Using technologies such as APIs or widgets, we may display parts of our Site (e.g., your boat listing page) on sites operated by GotoSailing.com’s business partners. If boat listings are displayed on a partner’s site, Charter Operator’s public information may also be displayed. When you make a reservation through one of our business partners’ websites, the business partners may receive certain parts of your personal data related to the specific reservation. They use this for their own internal purposes (such as analytical purposes) and, if you request, for the administration of loyalty programs or marketing. If you wish to understand how these business partners may process your personal data, please remember to read their privacy policies when you make a reservation on a business partners’ website.

When we offer you other travel-related products and/or services, your data may be shared with the related business partners. We may also exchange information about our users with business partners for fraud detection and prevention purposes, if strictly necessary.

Social Media Platforms

We may use certain limited personal information such as your email address, hash it and share it with social media platforms, such as Facebook or Google, where permissible within applicable law. We do this with the purpose of driving traffic to our websites, generating leads or otherwise promoting GotoSailing.com Site, our products and services. These processing activities are based on our legitimate interest in conducting marketing activities that help us offer you products or services that may be of your interest. GotoSailing.com does not control or supervise the social media platforms with which we may share your personal data. If you have any questions on how your social media platform service provider processes your personal data, these questions should be directed to the provider in question. Business Transfers

If GotoSailing.com undertakes or takes part in any acquisition, merger, reorganization, bankruptcy, sale of assets or insolvency event, then we may sell, transfer or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g. due diligence). In this case, before your personal information is transferred and becomes subject to a different privacy policy, we will notify you.

6. Communication Process between Us and Members

Through GotoSailing.com, Charterers and Charter Operators can use various means to communicate about reservations. You can contact GotoSailing.com through our Site, app, and other channels that we offer to ask questions about your reservation or about your accommodation partners. Communications on our Site may be reviewed, scanned, or analyzed for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, and customer support purposes. We may scan and analyze messages to mask contact information and references to other websites to prevent fraud. We may also scan, review, or analyze messages to debug, improve, and expand products. Automated methods to review information would be our first choice where possible, but there may be cases when we may choose to review some communications manually. We would do this for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your communications to send third party marketing messages to you, and we will not sell reviews or analyses of these communications.

We reserve the right to block the delivery of communications that we believe to contain malicious content, spam, or may pose a risk to you, accommodation partners, GotoSailing.com, or others. For all communications sent or received using GotoSailing.com, communication tools will be received and stored by GotoSailing.com. On the other hand, Business partners through whose platform you made the reservation and accommodation partners may choose to communicate with you directly by email or other channels. Please remember that GotoSailing.com does not control these channels.

7. Use of mobile devices and cross device tracking

We may have free apps for a range of mobile devices. We may also offer versions of our regular website that have been optimized for mobile and tablet browsing. The way these apps and mobile websites process the personal data you provide is not different from our website. But as an addition, they allow you to use location services to find accommodations nearby. With your consent, we may send you push notifications containing information about your reservation, potential reservations or any GotoSailing.com programs you participate in. You may grant us access to your location data or contact details for us to provide you with services you requested. When you upload a picture from your mobile device, that picture may be tagged with your location information. Please read the instructions of your mobile device to understand how to change the settings and enable the sharing of such data or the receipt of (or opt out of receiving) push notifications. Since different device operating systems may have different default settings, you might want to learn about such settings on push notifications.

In order to optimize our services and marketing activities, we may use a system called cross-device tracking. This may be done with or without the use of cookies. With cross-device tracking, GotoSailing.com is able to track user behavior across multiple devices. Using this system, GotoSailing.com may combine data collected from different sources. For example, data from a particular browser or mobile device can be combined with data from another computer or device linked to the computer or device from which the data was collected.
