Termos de Serviço
O preço do charter inclui:
- Uso do iate, inclusive de seus acessórios/equipamentos, pelo fretador e tripulação.
- Desgaste natural do iate,
- Prêmios de seguro conforme estabelecido no parágrafo 6,
- Suporte na base de atracação permanente do iate.
- Tarifas, taxas e impostos incorridos na base de atracação permanente do iate (exceto transitlog)
1. Depósito de segurança
A taxa de depósito de segurança deve ser paga na entrega do iate, por cartão de crédito, cartões de débito não podem ser usados para cobrir um depósito, somente cartões de crédito. Este depósito é reembolsado após a entrega do iate, sem danos, na base.
Uma taxa de depósito de € 2.500 aplica-se a todos os barcos até 50 pés. Uma taxa de compensação de depósito de € 200 por semana reduz a taxa de depósito para € 500.
Uma taxa de depósito de € 3.500 aplica-se a todos os barcos até 57 pés e catamarãs. Uma taxa de compensação de depósito de € 350 por semana reduz a taxa de depósito para € 1.000.
Para o Jeanneau 64 a taxa de depósito é de € 6.500. Uma taxa de compensação de depósito não é possível.
Se o iate participar de um raley ou regata, a taxa de depósito aumenta de € 2.500 até € 4.000 e de € 3.500 até 5.000. Uma compensação de depósito não pode ser nomeada. Com o Jeanneau 64 não é permitido participar em ralis ou regatas.
Uma taxa de depósito de € 500 aplica-se a todos os gennakers ou spinnakers. Uma compensação de depósito não pode ser designada.

2. Capitão/Capitão
O afretador ou o capitão por ele designado deve ter os conhecimentos e experiência necessários para guiar o iate em águas abertas e provar que possui as licenças de navegação necessárias. Se necessário, essas informações serão verificadas pela seguradora. O capitão nomeado confirma as informações e documentação fornecidas, com sua assinatura.
Se os afretadores e/ou capitães rescindirem suas obrigações de acordo com este contrato, antes do vencimento do afretamento, ou deixarem o iate antes do vencimento, o afretamento será considerado encerrado e o iate deverá ser entregue imediatamente ao afretador companhia. O afretador e/ou o capitão são totalmente responsáveis por todos os custos, perdas e danos incorridos à empresa de afretamento a partir deste afretamento quando não devolverem o iate nessas circunstâncias.
Se a empresa de fretamento determinar na entrega que o conhecimento náutico do fretador/comandante não é suficiente para guiar o iate com segurança, ou se a empresa de fretamento tiver dúvidas razoáveis sobre a capacidade de navegação do fretador/comandante, então a empresa de fretamento tem o direito de resolver a situação da seguinte forma:
- Faça um teste de várias horas sob a supervisão da empresa fretadora, às custas do fretador.
- Ou solicite uma mudança de capitão.
- Ou negar a permissão do iate para sair da marina. O iate pode então ser usado pelo fretador apenas em seu cais no porto de partida.
A entrega de um iate a pessoas intoxicadas ou incapacitadas geralmente é recusada pela empresa de fretamento.
3. Seguro
O iate está coberto por um seguro totalmente abrangente com franquia dedutível, que é o valor do depósito, para cada evento de dano, seguro de responsabilidade por danos pessoais e danos materiais até € 3.000.000,00. A franquia do seguro será suportada pelo afretador. O seguro não cobre danos pessoais causados por acidentes a bordo, danos a objetos em posse do afretador, intencionais ou danos causados por negligência grave.
4. Obrigações específicas do Afretador
O fretador deve nomear todos os passageiros (tripulação) até 4 semanas antes do início do fretamento, todos os membros da tripulação são considerados participantes responsáveis.
Se os tripulantes registrados não estiverem presentes no início do fretamento ou outros que não os tripulantes registrados chegarem, a empresa de fretamento tem o direito de recusar a saída do iate da marina.
O afretador deve manusear o iate e o equipamento com responsabilidade, em conformidade com as regras de navegação adequada, em particular o afretador deve:
- observe as disposições legais de qualquer país onde o navio ficará ou passará (consulte o manual do porto) e desembarque e desembarque de acordo com os regulamentos relevantes.
- mantenha o diário de bordo corretamente e deixe-o a bordo.
- inspeções completas e manutenção necessárias, rotativamente.
- veleje durante a noite com atenção especial aos regulamentos de segurança e navegação noturna.
É proibido:
- para realizar transporte pago de pessoas ou mercadorias,
- deixe o iate para terceiros.
- O diário de trânsito não deve ser alterado sem declaração oficial, as pessoas no diário de trânsito são definidas para a duração do fretamento ou as pessoas que não estão no diário de trânsito original devem ser registradas oficialmente a bordo.
- para levar passageiros a bordo na Grécia ou para levar passageiros para a Grécia.
- para transportar mercadorias tributáveis não declaradas ou mercadorias perigosas a bordo.
- mais passageiros do que a capacidade máxima permitida a bordo.
- para participar de regatas ou corridas (a menos que divulgado anteriormente).
- para rebocar outros veículos, a menos que estejam em perigo e não haja outros meios de resgate.
No caso de qualquer dano ocorrido durante o período de afretamento, o afretador deverá providenciar para que tal dano seja remediado prontamente e adequadamente até um valor de € 200. As peças substituídas devem ser mantidas. Em caso de qualquer dano maior, médio, possível atraso, perda, falta de manobrabilidade, apreensão ou obstrução do navio, o afretador deverá ser prontamente informado por telefone ou mensagem telegráfica. O afretador é responsável por tomar todas as medidas necessárias e expeditas para reduzir o nível de danos e quaisquer danos consequentes (por exemplo, deficiências) e, se aplicável, o afretador deve comissionar, registrar, supervisionar e fazer um pagamento antecipado para reparo após consulta com o afretador festa.
Em caso de dano ao iate ou qualquer ferimento pessoal, o afretador deverá registrar um registro e obter confirmação de apoio (por um capitão do porto, médico, comissário médio, etc.). Se o dano não puder ser reparado em andamento e a devolução for justificável de acordo com as circunstâncias dadas, o afretador é obrigado a retornar prematuramente após consulta ao afretador, para permitir que o reparo seja realizado na base antes do início do afretamento subsequente. Nos casos em que o afretador não seja responsável pelos danos sofridos, qualquer despesa realizada será reembolsada pelo afretador, mediante apresentação de recibo válido, e qualquer período de deficiência durante o qual o iate não possa mais ser usado (nem mesmo em parte) pelo afretador será compensado.
5. Prejuízo de Desempenho
Se o Afretador não puder iniciar o afretamento, ele deverá informar imediatamente a parte afretadora. As taxas de cancelamento são as seguintes:- Desde a assinatura do contrato de afretamento até 8 semanas antes do início do período de afretamento – 40%
- menos de 8 semanas antes do início do período de afretamento – 60%
- menos de 6 semanas antes do início do período de afretamento – 80%
- menos de 4 semanas antes do início do período de afretamento – 100%
Se a parte de afretamento não puder ter o iate, ou um iate substituto de igual qualidade, disponível em tempo hábil ou de todo, o ARRENDADOR poderá reivindicar uma redução das taxas de afretamento para esse período de deficiência, ou para rescindir completamente o contrato.
No caso de dano ou perda de qualquer parte do equipamento, ocorrido durante o afretamento anterior, e a substituição dessas peças não puder ser obtida em tempo hábil, o afretador não poderá rescindir o contrato. Somente se a navegabilidade do navio for prejudicada, tornando perigoso entregá-lo ao afretador seguinte.
Toda e qualquer reclamação adicional por danos pelos quais a parte afretadora não seja responsável será excluída com relação à indenização do afretador por danos consequentes de acordo com o parágrafo 9 deste documento.
6. Entrega do iate
O iate será entregue cheio de combustível ao fretador. A condição do iate, a integridade do equipamento e o inventário serão verificados cuidadosamente pelo afretador no momento da aquisição, de acordo com um cronograma de equipamentos e confirmados pela assinatura do afretador.
7. Retorno do iate
Ao final do afretamento, o afretador deverá devolver o iate, reabastecido e em condições razoavelmente limpas (interna e externamente) ao afretador, permitindo-lhe verificar a condição do iate e a integridade do equipamento. Quaisquer itens de equipamentos perdidos, danificados ou não funcionando devem ser relatados imediatamente após a devolução, pelo afretador.
Se o navio não tiver sido reabastecido (água, diesel etc.) no retorno, o afretador deverá reembolsar o afretador pelas despesas incorridas para concluir esses serviços. Esses custos serão pagos no total no resort.
Qualquer dano oculto será compensado pelo afretador mesmo após o reembolso do depósito de segurança.
Os depósitos de segurança pagos serão reembolsados sem dedução, se não houver danos. Em caso de perda ou dano, o depósito de garantia será retido, total ou parcialmente, conforme exigido pela extensão de tal perda ou dano, até que a contabilização final dos custos incorridos seja determinada, a menos que a contabilização imediata seja possível.
8. Extensão, Atraso e Devolução
O check-out do iate deve ser feito no porto de retorno, no horário agendado. O período de afretamento não pode ser prorrogado sem o consentimento do afretador. Dificuldades devido às condições climáticas não afetarão a obrigação de devolver o iate pontualmente. Portanto, o fretador é obrigado a manter o iate a uma distância suficientemente próxima do porto de retorno, durante as últimas 24 horas anteriores ao final do fretamento.
No caso de qualquer atraso, a taxa de afretamento por excesso de tempo será dobrada, como uma violação de penalidade contratual.
Se a empresa de fretamento não for notificada imediatamente sobre um atraso na devolução, dentro de 16 horas da data e hora de devolução contratual do iate, ela apresentará automaticamente um relatório oficial às autoridades competentes.
Caso o passeio tenha que ser encerrado em um local diferente do porto estipulado, o afretador deve ser notificado imediatamente. O afretador compromete-se a deixar uma tripulação devidamente qualificada com o iate para vigilância do mesmo, até que o afretador possa retomar a posse do iate. As obrigações contratuais do afretamento não terminarão antes de tal aquisição.
9. Responsabilidade do Afretador e do Afretador
Ambas as partes que entrarem em um contrato de afretamento serão responsáveis por suas próprias falhas. Além disso, o afretador será responsável apenas pela retenção do valor da cobertura do seguro conforme coberto no parágrafo 5, portanto, não por danos consequentes ou similares, a menos que tenha agido deliberadamente ou com negligência grave, ou a seguradora se recuse a fornecer cobertura pelos motivos que apresentarão, declarando que o afretador é responsável.
As reclamações por danos por parte do afretador são limitadas ao valor da taxa de afretamento acordada se a empresa afretadora não for responsável por negligência grave ou má intenção. A empresa charter não é responsável por danos à vida, corpo, saúde ou pertences pessoais. O afretador, o capitão e os membros da tripulação são os únicos responsáveis por esses riscos, pois esses são os perigos e riscos aceitos e associados de um cruzeiro em alto mar.
10. Jurisdição – Diversos
Todos os contratos de afretamento serão regidos pela lei da República da Turquia. O local de jurisdição será Marmaris, na medida do legalmente permitido.
No caso de qualquer disposição deste documento ser nula ou ineficaz, a validade das partes restantes deste documento não será afetada.

A área de navegação é limitada a um raio de 70 milhas náuticas a partir das coordenadas da base para fretamentos de uma semana.

This is our return to Gocek from 2019 and the response to our email for a reservation was really helpful and booking straightforward. Pricing and payment details are clear and easy. Last time the shore crew were great and the boat was immaculately cleaned and fully prepared for us with a detailed handover before departure. The only glitch which is worth remembering was the queue for the fuel berth when returning. This may have changed so we’ll see and ask about it before we leave and plan our return accordingly. Very happy to be back with Goto Sailing.

Within seconds of asking a question on the popup chat, on a weekend, I got a real person who handled several questions from me over the next half-hour. He could see everything I had filled out on the website, so we didn't waste time on the facts. The next day, I chatted with more questions. The customer service rep was a different person but she knew everything about my case including promises that they had made to chase down some photos. The website presents a lot of information about every boat in an orderly way. Excellent. What remains is the actual charter experience. Hoping it goes as well as the booking process did.

The yacht was perfect
The yacht was perfect and all difficulties were solved at once (We had some misunderstanding around the transfer from airport). Thank you very much for your kind assistance! I would also like to thank GotoSailing managers for their assistance. There are some problems with the sight (may be because of my using tablet instead of PC). I filled the transfer form, but only second part was saved.. and I did not check it. But everything was solved after and we enjoyed our trip!

Excellent and prompt communication! Appreciate the patience with our various requests for information about the boat, itinerary and charter operator. The charter operator at ACI Split Marina, Euromarine, was very responsive prior to the trip. If you have chartered before and are a reasonably experienced skipper you should be fine, but don’t expect a formal briefing and thorough pre-inspection like with a Sunsail/Moorings. That said, the boat was immaculately clean and everything worked as advertised. Two minor issues: the boat Tanpopo I is listed as a 2019 model, it’s a 2018. There was a lack of communication and urgency from the receptionists in the Euromarine office in informing us when our boat would be ready at pick up. Our boat returned with a broken window from the previous charterer which appeared to be promptly fixed. There was a disconnect between the dock workers and receptionists who never called us as promised to tell us the boat was ready. Stopping in every hour to ask was fruitless. Finally, we just loaded up the boat and found a worker to do the check out, getting out of the marina late at 6 PM.

Gotosailing was great but didn't translate on the the ground/water
The service from Gotosailing was great but sadly didn't translate onto the ground/water at the beginning of our holiday. The charter company did not cover themselves in glory when we first arrived. They had not got our snorkelling kit, or our SUPs ready and although we were told we could pay for the insurance by credit card, we couldn't and they were very reticent to give us a receipt of the money received. Later in the week when we went back into port they were more efficient. Also I would expect to be able to do an online shop before getting there so not having to spend 2 hours in the sweltering heat shopping for basic supplies. Doing a small shop would be acceptable. The food list that was sent over to us was not extensive at all.

We had to “test” everything onboard
- echosounder unit wasn’t connected so we had to do it ourselves after 2 days when we finally figured out the error (owners told us it was working the day before which was BS since the cable wasn’t connected) - bow (jet) thruster stopped working already the first day and couldn’t be repaired although we rerouted our trip to meet up with maintenance staff - no electrical fans nor solar panels were installed although it was part of the inventory list at the time of booking - the boat didn’t have any gangway and we were promised to get one after one day (but we didn’t) - the boat was equipped with a wrong water supply setup which made the refilling of water a nightmare - the dinghy was left with 1-2l of fuel and the dinghy itself could barely take two people onboard All in all, we were the first group to charter the boat since delivery and we had the unfortunate situation to “test” everything onboard

I couldn't recommend GotoSailing highly enough.
I hired a 37 ft Bavaria 2006 In Split in the second week of July 2019. The boat was a great price which was a bit of a worry from a company I had never dealt with before but I needn't have worried - see below. I had many dealings with Fleur and Dave of the office who were excellent. I dealt mostly with Fleur who was prompt and very supportive. I had a few problems before I arrived which meant a lot of correspondence with Fleur. My flight got in at 1am so the taxi service had to wait for me - No problem! I had problems in delay in getting my ICC Cert renewed before departure which meant i would to have hired a local skipper at Euro 1000 - GotoSailing offered to pay a significant portion so I could enjoy my holiday. I was very appreciative of their offer. In any event, my Cert arrived in time so didn't need a skipper.The Base Office manager Kristina was very helpful - West Cork is the place to go on holidays Kristina! The Base Manager Nicolai was brilliant. I rang him a few times over the week and he was patient and offered lots of additional local knowledge advice re anchoring spots etc. The Boat was not a new one but in great condition. Everything worked and was spotlessly clean. The engine was very well maintained and the sails as good as new. The only 2 areas of possible improvement might be the size of the dinghy (2 large adults and 2 chunky teenagers made for interesting transfers from anchor at night in windy conditions) and the electronic chart plotter was not fixed close to the wheel which having to go below but maybe Im spoilt as my own 36 footer has that facility with a bigger dinghy! I couldn't recommend Goto sailing highly enough. They really wanted me to have a good time and went the extra mile, particularly offering to pay costs on what was a low profit week for them with their original excellent offer. Can't beat the Greek Islands!
We sailed with friends who had a larger boat from another company and our boat was better equipped and more functional in so many ways. Having solar power was a godsend, allowing us to charge the fridge/etc. all day and keep the important refreshments ready to share with our friends. Chartering team was very helpful and quick to check us in all clear. Can't beat the Greek Islands so hope to go again soon! The only confusion when trying to book was a map of the area relative to our friends. Otherwise all good.
